1- لا يقتل رجل اذا قتل ابنه !
و اسباب ذلك
1- حديث " لا يقاد الوالد بولده " الترمذي 1400 , صحيح الجامع الصغير 7744
2- حديث " انت و مالك لابيك " صحيح الجامع الصغير 1486
3 - الاجماع الذي ذكره الشافعي , العمراني : البيان 11 \ 318
4- الولد جزء من الوالد , ولا يقتص من جزء لجزء ! ابن القيم مفتاح دار السعادة 2 \ 532
5- الوالد سبب حياة الولد , فلا يصح ان يكون الولد سبب موت الوالد ! ابن قدامة , المغني 11 \ 377

تفضل المالكية بالتكرم بقتل الوالد اذا قصد القتل العمد لا قتل التأديب !



2- لا يقتل رجل حر اذا قتل عبدا!
و اسباب ذلك
1- البقرة 178
2- حديث "لا يقتل حر بعبد " ضعيف الجامع 6363
3- صنيع ابو بكر و عمر البيهقي السنن الكبرى 15936

تفضل الاحناف بالتكرم بقتل الرجل اذا قتل اي عبد الا عبيد نفسه


3- لا يقتل مسلم اذا قتل كافرا !
و اسباب ذلك

3 - حديث " لا يقتل مسلم بكافر " البخاري ح 6903 , الترمذي ح 1412
4- حديث " لا يقتل مؤمن بكافر " احمد 2 \ 192
5- قول عثمان : لا يقتل مسلم بكافر و لو قتله عمدا " عبد الرزاق ح 18492 , ابن ابي شيبة 6\ 364 , البيهقي , السنن الكبرى ح 18493
و مثله عن على و معاوية و زيد بن ثابت .
6- صنيع عمر عبد الرزاق ح 5809
و مثله عثمان ارواء الغليل 2262


تفضل الاحناف بالتكرم بقتل المسلم اذا كان الكافر المقتول ذميا فقط
تفضل المالكية بالتكرم بقتل المسلم اذا قتل الذمي بغل فقط
