بهذا يرى الكاتب أن النص الحالي لكتاب الله نصًّا مفارقًا، بمعنى أنه نزل لظروف خاصة ببيئة خاصة بعصر معين ومن ثم لابد ان يفارقنا ونفارقه لأنه لم ينزل لنا، ويسميه "الثابت"، ولابد أن نستنبط نحن احكامنا وقوانيننا حسب نظرتنا لمجتمعنا وحسب عصرنا فقط لاغير، ويسميه "المتحول":

ص180: "فنحن اليوم، كما سبقت الإشارة إلى ذلك، نتعامل مع نص افتقدنا فيه "وضعية الخطاب" لما كان قرآنًا بالمعنى الحقيقي للكلمة. ولكن ذلك لا يمنع من القول إن الله، على حد رأي الطالبي، يجيب عما يلقى عليه من أسئلة، ولكنه لا يقدم إجابات نهائية أو يصوغ نظرية معينة، وإنما يدعو الناس إلى البحث والنظر والتفكر. ولذلك لم ينتبه القدامى إلى أن السؤال والجواب في علم أسباب النزول لهما طبيعتان مخصوصتان من جهة، ومرجعان متباينان: بشري نسبي وإلهي مفارق من جهة أخرى." أ. هـ
ص 304، 305: "غير أن القدامى لم يتحملوا مسؤوليتهم كاملة في الاستفادة من ذلك الانفتاح الذي كان قائمًا بين "المفارق" و "المحائث" (بشأن الناسخ والمسنوخ) رغم وعيهم به وإدراكهم لمقاصده ودلالاته. ولعلنا نعثر في بعض الأخبار على ما يؤكد دعوانا. فهذه عائشة تقول متحدثة عن النساء المسلمات من الإماء: "لو عاش رسول الله صلى الله عليه وسلم إلى وقتنا هذا لمنعهن من الخروج إلى المساجد كما مُنِعت نساء بني إسرائيل" (تفسير القرطبي، م.م، ج: XIV، ص157). فالمبدأ الأساسي الذي ينبغي أن تقوم عليه فلسفة النسخ متضمن في هذا القول، ويتمثل في التعامل مع الأحكام القرآنية من باب مدى ملاءمتها لخصوصيات المجتمعات التالية لمجتمع الدعوة من جهة ومدى تعبيرها عن مشاغل هذه المجتمعات وانتظارها من جهة أخرى." أ. هـ
ص305: ولئن نعتنا العلاقة بين أسباب النزول والنسخ بالثابت والمتحول، فإن القدامى بدل أن ينعتقوا من سلطان "الثابت" وأن يهرعوا إلى "المتحول" تحقيقًا لمقاصد الشريعة وإنجازًا لرهانات الرسالة المحمدية الضمنية والصريحة، فإنهم احتموا بالثابت يقرؤون به المتحول." أ. هـ
ص306: "ثم لابد من فهم النص في مقاصده الإيجابية وتحريره مما كبله به القدامى من قيود منعوا بها نسخ الأحكام القرآنية بعد انتهاء الوحي المحمدي معتبرين إياها مُلْزِمة للمسلمين على مر العصور دون مراعاة لتغير أوضاعهم الاجتماعية والثقافية تغيرًا جزئيًا أو جذريًّا." أ. هـ

لذلك فمن منهم لم يناسبه نظام الصلاة المحمدي، أي الصلاة كما كانت على عهد سيدنا محمد صلى الله عليه وسلم فلا مانع أن يخترع لنفسه نظامًا خاصًا يساير ظروفه وبيئته وعصره. فقد لا يصلي بالمرة ومع ذلك فهو من أولياء الله عز وجل.
