أين المشكلة في تطبيق الشريعة ؟

المشكلة تكمن في ان الشريعة ببساطة تتعارض و حقوق الانسان. فغاية المجتمع المتمدن و الحديث هو اعادة تأهيل المجرم ليصبح عضوا فاعلا في مجتمعه. فالغاية مثلا من حبس السارق تتمثل في امرين، الامر الاول حماية المجتمع بحبسه فترة معينة يتم خلالها اعادة تأهيله نفسيا ليعود فردا نافعا بالمجتمع و الامر الثاني يكمن بردع غيره من القيام بجرم السرقة. فلو طبقت الشريعة بحقه لتم بتر يده فيصبح بذلك عالة على مجتمعه علاوة على الاذى الجسدى و النفسي الذان يلحقان به بسبب تطبيق هذا الحد الهمجي مما يحط من كرامته كانسان. هذا غير تدخل الشريعة بخصوصيات الفرد الشخصية و محاكمتها له بالجلد او بالرجم. و التميز من خلالها بين الذكر و الانثى عند الشهادة مثلا، وعدم المساواة و العدل بين ابناء المعتقدات المختلفة.
و لهذا السبب يكون الواجب على الطبقات المثقفة و الواعية دعوة كل مجتمعات الارض الى تطبيق قوانين تتفق و حقوق الانسان، و اذا وجد مجتمع جاهل يكون الواجب توعيته وليس تشجيعه على انتهاك حقوق افراده
