بمنتهى البساطه هل نكاح المتعه فعلا حرام ام هو حلال
للاجابه على هذا السؤال
يجب ان نعرف ما هي قواعد النسخ في القران الكريم

( ما ننسخ من آية أو ننسها نأت بخير منها أو مثلها ألم تعلم أن الله على كل شيء قدير

يعني اذا اراد الله نسخ ايه
يجب ان ياتي بايه اخرى تنسخها
ولهذا نجد ان السنه لا تنسخ القران

وا : نأت بخير منها أو مثلها ، والسنة لا تساوي القرآن ، وقد قال عليه السلام : القرآن ينسخ حديثي ، وحديثي لا ينسخ القرآن ، ولأن السنة لا تنسخ لفظ القرآن ; فكذا حكمه .

وأما نسخ القرآن بالسنة فهذا لا يجوزه الشافعي؛ ولا أحمد في المشهور عنه؛ ويجوزه في الرواية الأخرى

طيب وهل نكاح المتعه من السنه

وقال سفيان الثوري ووكيع ، عن إسماعيل بن أبي خالد ، عن قيس بن أبي حازم عن عبد الله بن مسعود قال : كنا نغزو مع رسول الله صلى الله عليه وسلم ، وليس معنا نساء ، فقلنا : ألا نستخصي؟ فنهانا رسول الله صلى الله عليه وسلم عن ذلك ، ورخص لنا أن ننكح المرأة بالثوب إلى أجل ، ثم قرأ عبد الله : ( يا أيها الذين آمنوا لا تحرموا طيبات ما أحل الله لكم [ ولا تعتدوا إن الله لا يحب المعتدين ]

يعني طبقا لاسباب النزول نكح المتعه من الطيبات التي احلها الله


وحتى رسول الله تمتع بمتعه النساء

1 - تمتع نبيالله صلى الله عليه وسلم وتمتعنا معه .

خلاصة حكم المحدث: صحيح


 1 - كان ابن عباس يأمر بالمتعة . وكان ابن الزبير ينهى عنها . قال : فذكرت ذلك لجابر بن عبدالله . فقال : على يدي دار الحديث . تمتعنا مع رسول الله صلى الله عليه وسلم . فلما قام عمر قال : إن الله كان يحل لرسوله ما شاء بما شاء . وإن القرآن قد نزل منازله . فأتموا الحج والعمرة لله . كما أمركم الله . وأبتوا نكاح هذه النساء . فلن أوتى برجل نكح امرأة إلى أجل ، إلا رجمته بالحجارة . وفي رواية : بهذا الإسناد . وقال في الحديث : فافصلوا حجكم من عمرتكم . فإنه أتم لحجكم . وأتم لعمرتكم .

وهناك من صرح ان الله لم ينسخ نكاح المتعه

1 - تمتعنا مع رسول الله صلى الله عليه وسلم فلم ينه عنها ولم ينزل فيها كتاب ينسخه
